You cannot file form I-539 to request and extension of stay or a change of status to any of the following classifications:
- E-1 principal Treaty traders/employees
- E-2 principal Treaty investors/employees
- E-2 CNMI principal investors
- E-3 principal workers from Australia
- H-1B/H-1B1, H-2A, H-2B, H3
- L-1
- O-1, O-2
- Q-1
- R-1
- TN-1 and TN-2
