What is the purpose of this form:

  • If you wish to extend your stay inside the States
  • If you wish to change your status to another temporary status
  • Commonwealth of the Northern Mariana Islands (CNMI) residents
  • F and M students applying for reinstatement

You cannot file form I-539 to request and extension of stay or a change of status to any of the following classifications:

  • E-1 principal Treaty traders/employees
  • E-2 principal Treaty investors/employees
  • E-2 CNMI principal investors
  • E-3 principal workers from Australia
  • H-1B/H-1B1, H-2A, H-2B, H3
  • L-1
  • O-1, O-2
  • Q-1
  • R-1
  • TN-1 and TN-2
