I was born in the United States; however, I was only there for a few years before my family moved back home to Ireland. I have two children under the age of 21, and I wanted to get them their U.S. citizenship. I contacted Caro, and she explained that I qualified for CRBA (Consular Registration of Birth Abroad).
I went to the U.S. Consulate in Dublin, but they denied both citizenship (CRBA) applications. They stated that I did not have enough physical presence evidence in the United States. I needed to show several years of physical presence, two of which must have been after I turned 14 years of age. I was completely disheartened. Caro reached out to the Consulate, but they weren’t willing to help us. They maintained I did not qualify. Caro said they were incorrect. I would have given up had Caro not told me the law. Consular officers have an important role but they are not attorneys so don’t be dissuaded if they tell you something speak to Caro and go by what she says.
Caro then filed a Freedom of Information Act request and was able to gather more evidence of my physical presence in the United States this took another 8 months. However, the Consulate denied my application again.
Caro then suggested we file with USCIS, so she submitted two N600K application (Application for Citizenship and Issuance of Certificate Under Section 322). After responding to an RFE; USCIS responded by saying that my sons did need to file the N600K application because they could obtain their citizenship under CRBA – this is what Caro had argued all along and she used this argument to convince the consulate they had to deny my sons. I didn’t fully understand the letter and thought the case was over, but Caro said that we were going back to the same Consulate that had denied us twice. Caro sent a long legal argument to the Consulate. Told me what documents we needed to upload to the consulate and she did not charge me extra for her legal time no matter how many times I asked her because she said she was so bothered by how long all of this took. We were now fighting for citizenship in excess of 5 years.
We filed everything online, and she reviewed everything with me before my interview. Last week, I received confirmation that the Consulate approved both of my sons for U.S. citizenship. I would never have been able to do this by myself. Not only did Caro understand the law, but she also fought for me sons and this is what you hire a laywer for.
Yes, it cost a lot of money and took nearly seven years to get this done, but both of my children now have U.S. citizenship, and I’m incredibly thankful.
